ΓΕΝΙΚΟΙ ΟΡΟΙ & ΠΡΟΫΠΟΘΕΣΕΙΣ ΠΩΛΗΣΗΣ
1. Introduction
1.1. The conclusion of distance sales contracts for "sperare" brand products is carried out through this website (hereinafter "The Website") and is governed by the following General Terms and Conditions of Sale.
The products available for sale through the Website are sold directly by the company sperare (hereinafter "sperare"). sperare is legally established and operates in accordance with Greek law, with headquarters in Thessaloniki, Perea
1.2. The use of distance sales services in accordance with these General Terms and Conditions of Sale is intended exclusively for consumers (hereinafter "the Customer" or collectively "the Customers") over the age of 18 (or even younger with the approval of their legal guardian), i.e. to natural persons acting for purposes unrelated to any commercial, business, craft or professional activity.
1.3. The products available for sale through the Website can be delivered to an address within Greece and Cyprus.
1.4. The languages used to conclude the sales contract through this Website are Greek and English.
1.5. These General Terms and Conditions of Sale are published on the Website for the information of Customers, storage and reproduction, in accordance with applicable legislation.
1.6. The purchase of products is governed exclusively by the General Terms and Conditions of Sale published on the Website, as they apply at the time of each sale.
sperare reserves the right to modify and/or supplement these General Terms and Conditions of Sale at any time.
Any amendment and/or addition will only apply to purchases made after the date of publication of the new version of the General Terms and Conditions of Sale.
The replacement of the General Terms and Conditions of Sale with a new version thereof automatically entails the non-application and inactivity of the previous version, in terms of sales made after the removal of the previous version from the Website and also in the event that the (previous) General Terms and Terms of Sale are in any way accessible and/or available to the public through websites other than this one.
2. Availability of products
2.1. The Customer acknowledges that the products offered by sperare on the Website (hereinafter "the Products") are limited in number and therefore knows that sperare will check their availability at the time of purchase.
2.2. Occasionally certain Products may not be available. In these cases, sperare will inform without delay (and in any case within the deadlines provided below) by email that the order placed has been cancelled.
In the case of partial availability of the ordered products, the Customer will be informed accordingly. However, the Customer agrees and agrees to receive only the Products that are available, unless it has elected on the Website to receive the entire order in its entirety. In this case, the Customer will be asked if he wishes to receive only the Products that are available or to cancel his order altogether.
2.3. sperare reserves the right to modify the items sold on the Website at any time without notice.
3. Transaction Process
3.1. Each product available for sale will be displayed on the Website by following the link displaying the product images, price per unit, colors and sizes (if applicable). For Products expressly marked on the Website as "Pre-Order" or "Pre-Ordered Product" or as "Customized Products" that are not yet ready to ship, the corresponding dedicated link will also display the relevant estimated delivery date.
3.2. The Customer may purchase one or more Products. sperare reserves the right to modify at any time the restrictions on the number of Products that can be purchased from the Website.
3.3. The Products selected by the Customer will be placed in a separate section (hereinafter "Shopping Cart").
A description of the Products, including measurements or sizes (as applicable), together with one or more photographic images in digital format clearly showing the Products, will be included in the Customer's Shopping Cart.
3.4. Although sperare constantly takes measures to ensure that the photos shown on the Website accurately represent the original products, there may be deviations due to the technical characteristics, color resolution of the device used by the Customer. Therefore, sperare will not be responsible for possible inadequacy of the graphic representations of the Products displayed on the Website if they are due to the above technical reasons.
3.5. To view the Products selected and the total price of the order, please visit the "Shopping Cart" page.
Before confirming the relevant order (hereinafter "the Order"), the Customer must check the accuracy of the contents of the Shopping Cart and complete the order in accordance with the instructions provided on the Website.
3.6. The transaction process is completed when the Customer selects the relevant button to confirm the final transaction (hereinafter "Transaction Button"), which validates the purchase, which is immediately submitted to sperare. After selecting the Transaction Button, the content of the purchases will not be able to be modified by the Customer.
3.7. Before confirming the Order, the Customer must confirm that he has read and accepts the General Terms of Sale herein. At the end of the transaction process, the Customer is advised to save or print the General Terms of Sale.
3.8. The transaction process must be fully completed, any failure to complete it means that the Order cannot be submitted to sperare.
3.9.Each Order, as well as the Customer's data required for the transaction will be stored by sperare for the period of time provided for and in compliance with applicable laws. Any use of the Customer's data for non-transactional reasons will be subject to the relevant prior and express consent of the Customer in accordance with the terms stated in the "Privacy Policy Statement" posted on the Website.
3.10. Customers who have registered to connect to this particular area of the Website can check the progress of the Order by logging into this area and entering the "My Orders" page.
3.11. The Customer acknowledges that he/she is responsible for the accuracy and truthfulness of the data entered on the Website or used at the time of the transaction.
3.12. The Customer acknowledges that on the Website it may still be possible to:
to pre-order a range of Products prior to their marketing or distribution and placing on the market, and
to order Products that he wishes to personalize permanently by adding non-removable customizations according to the methods indicated on the Website (for example through thermography).
The Customer acknowledges that the Products in question are not yet available for delivery at the time the relevant Order is placed. Products that may be pre-ordered by Customers are clearly identified and marked on the Website with the wording "Pre-Order" or "Pre-Ordered Product", and Products that can be personalized by Customers are clearly identified and marked on the Website with the wording "Personalized Products" ».
3.13. The Customer acknowledges and agrees that if he orders a Product, and/or orders a Personalized Product, the corresponding price listed on the Website and displayed in the Shopping Cart section will be charged in advance to the Customer at the time of receipt of the Confirmation Email, as defined in the paragraph below 4.2, even though the Pre-Ordered Product and Personalized Product are not ready for dispatch at that time.
The Pre-Ordered Product and the Personalized Product will be delivered to the Customer within the respective estimated date stated in the Product page description.
In the event that the Order submitted by the Customer also includes one or more Pre-Ordered Products and/or Personalized Products in addition to the Products already available, all corresponding prices with respect to said Order will be charged in advance to the Customer at the time of receipt Confirmation Email, even if such Pre-Ordered and Personalized Products are delivered on the respective projected dates stated in the Product page description.
3.14. Any further clarification regarding payment, delivery and confirmation of Pre-Ordered Products and Personalized Products is set out below in the respective paragraphs.
3.15. The Customer acknowledges and agrees that, except as specifically provided herein for Pre-Ordered Products and Personalized Products, the other paragraphs of these General Terms and Conditions of Sale shall also apply to Pre-Ordered Products and Personalized Products.
4. Execution of the Agreement
4.1. Upon confirmation of the Order, the Order is submitted to sperare for processing, and cannot be further modified or cancelled. sperare will process the Order submitted by the Customer only if it has been duly completed and no errors are reported on the Website.
After submitting the order, the Customer will immediately receive an e-mail confirming that sperare has received the Order. In any case, this does not mean that the Order has been accepted. The acceptance of the Order by sperare and the conclusion of the contract will be carried out as described in paragraph 4.2. below.
4.2. The Agreement between sperare and the Customer will be deemed to have been executed if the Customer receives one or more transaction confirmation emails from sperare (hereinafter Confirmation Emails).
The Confirmation Email will be sent to the address indicated by the Customer in the order form and will include the relevant confirmation, as well as a summary of the terms of the Sale, such as: the description of the Product and its main characteristics, the total price of the order, including shipping costs, complaint address, information on after-sales services, as well as the Customer's right of withdrawal and its exercise.
4.3. sperare reserves the right not to accept the Order submitted by the Customer in the following cases: :
a) the Products included in the Order are not available notwithstanding what applies to Pre-Ordered Products.
b) There is a legal dispute between sperare and the Customer, resulting from a previous Order.
c) The Customer has violated the General Terms of Sale in previous cases or has not fulfilled the obligations arising from them.
d) it appears that the Customer purchases the Products with the intention of reselling them or selling them for commercial or professional purposes.
e) the Customer has been involved in or is suspected of illegal or fraudulent activities.
In such cases, sperare must inform the Customer by email within 30 days from the day of receiving the Order about the cancellation of the specific Order. In these cases, it will be considered that no Order has been accepted by sperare.
4.4. In the case of partial availability of the Products, if the Customer has chosen to receive the entire Order as a whole, he will be asked if he wishes to receive the Products that are available or to cancel the Order entirely. If the cancellation is only partial, the Customer will be charged only the price of the Products actually purchased.
The Customer agrees and agrees to receive only the Products that are available, unless he has chosen on the Website to receive the entire Order as a whole.
5. Price and Method of Payment
5.1. The prices of all Products available for sale on the Website include VAT.
5.2. The relevant prices will be displayed in Euros.
5.3. The total price displayed in the Shopping Cart includes shipping costs, which should be listed separately. In any case, sperare will seek the Customer's prior consent to any additional charge.
5.4. The prices shown on the Website and listed in the Shopping Cart when the Customer confirms the Order by selecting the Buy Button will be charged to the Customer, provided that the Products ordered are available at that time, except for the Order which includes the Pre-Ordered Products and /or Personalized Products for which the corresponding amount will be charged in advance in accordance with the following clause 5.6, even if they are not yet ready for dispatch at that time
Sperare reserves the right to modify the prices of the Products available for sale on the Website at any time and without notice.
5.5. Sperare only accepts credit cards and other payment methods only if they are expressly stated on the Website.
5.6. With regard to credit card payments, the Customer confirms and warrants that he/she is the owner of the credit card used for the transaction, as well as the accuracy of all relevant data entered at the time of the transaction, such as: credit card number , expiration date, and (if applicable), security code.
Transaction amounts will be charged to the Customer only after:
(i) the verification of the credit card details, (ii) proof of the issuing company of the credit card used by the Customer under direct debit authorization, and (iii) confirmation by sperare that the product is available and in any case , once the Order is ready for processing.
Both for Orders that include only Pre-Ordered Products or Personalized Products and for Orders that also include Pre-Ordered Products and/or Personalized Products, the total amount of the transaction will be charged for all Products – i.e. those Products that are already available at that time time, and Pre-Ordered Products and/or Personalized Products that have not yet shipped at that time – at the time of the Confirmation Email.
5.7. For the purposes of payment through other payment service providers, the Customer confirms and warrants that he is the owner of the account used for the transaction. Customers will only be charged the relevant amount of the transaction after receiving the Confirmation Email from sperare.
5.8. Purchased Products will only be shipped after timely payment of the amount owed by the Customer. In the event that the Customer cannot be charged the amounts due for any reason, the sale process will be automatically terminated and the sale will be canceled and the Customer will be notified accordingly.
5.9. In the event that one or more Products are not available and the Customer has decided not to cancel the order in its entirety, the price of the available Products and all possible shipping costs should be charged.
6. Distribution
6.1. The Customer will receive the entire Order in a single shipment. Products will be delivered to the address indicated by the Customer in the Order. The Customer's signature will be requested upon delivery of the Products.
6.2. For security reasons, sperare will not process any order addressed to the post office and will not accept any order that does not allow the identification of the natural person who is said to be the recipient of the order as well as the relevant address.
6.3. The Products available for sale on the Website will be able to be distributed to the addresses of the countries mentioned above (chapter 1.3). In view of the above, any Order that includes distribution outside of these countries will be automatically rejected during Order processing.
6.4. In the event that the Customer is charged with shipping costs, these costs should be explicitly stated and separately from any other expense or expense when completing the Order before selecting the "Buy Button".
6.5. In compliance with applicable law, the time limit within which sperare is obliged to distribute the purchased Products, is 30 (thirty) days from the date of conclusion of the contract, with the exception of cases of force majeure
In any case where the respective Order concerns Pre-Ordered Products and/or Personalized Products, the delivery date will not exceed 30 days and sperare will distribute these Products on the respective scheduled dates or during the scheduled time period it has agreed with the Customer, as presented to the Customer in the description of the Product page.
6.6. In the event that sperare fails to deliver the Products within the above time limit, the Customer may require sperare to deliver such Products within an additional time limit appropriate in the circumstances, in accordance with applicable law.
The Customer in any case reserves the right to terminate the contract if the ordered product is not delivered within the stipulated additional time limit.
6.7. sperare has the right to split the Order into several shipments, depending on the availability of the Products for distribution, and the Customer will receive the Products separately as soon as they are available for shipment, unless he has chosen on the Website to receive the Order as a whole. sperare has the option of either billing the Customer for the Products as and when they are shipped or as a lump sum payment.
6.8. Μόλις το αγορασθέν Προϊόν αποσταλεί, ο Πελάτης λαμβάνει email στη διεύθυνση που αναγράφεται στην παραγγελία. Το email αυτό πρέπει να περιλαμβάνει κωδικό παρακολούθησης της αποστολής και ένα σύνδεσμο που θα επιτρέπει στον Πελάτη να παρακολουθεί σε πραγματικό χρόνο στην πορεία της διανομής. Η Εξυπηρέτηση Πελατών της sperare Customer Service θα παρέχει την απαιτούμενη βοήθεια σε οποιοδήποτε πρόβλημα παρουσιαστεί σχετικά με τη διανομή. 6.9. Alternatively, instead of delivery by courier, the Customer may request to collect the purchased Products directly from the store selected on the Website at the time of purchase, provided that the corresponding Order does not include Pre-Ordered Products and/or Personalized Products. In the event that the Customer does not receive the Products within 30 (thirty) days of receiving the email informing him/her that the Product is available for collection, the transaction may be canceled by sperare. In this case, the Customer is informed by email of the cancellation and is compensated for the amount paid.
6.10. The Customer bears the risk of loss or damage to the Product once he/she or a third party designated by the Customer, other than the carrier, is in possession of those products.
In the event, however, that the loss or damage to the Product occurs prior to receipt by the Customer or a third party designated by the Customer, sperare shall reimburse the Customer for any amount paid.
7. Product Compliance
7.1. At the time of receipt, the Customer must check the Products to verify that they correspond to the items ordered and that they do not show any manufacturing defect or lack of conformity. The sale of sperare products is subject to legal guarantees provided for in accordance with applicable laws, as well as additional contractual guarantees that may be provided in favor of the Customer.
7.2. In case of manufacturing defects or lack of conformity, the Customer is entitled to demand the restoration of the conformity of the Products either through repair or replacement of the Product, free of charge, unless the requested restoration is objectively impossible or extremely burdensome in relation to another restoration . If any of the cases provided for in the law occur, the Customer may request an appropriate price reduction or the termination of the contract and subsequent compensation of the price paid. It is understood that the Customer loses this right if he does not notify sperare of the lack of conformity of the Product within two (2) months from the date the defect was discovered.
7.3. To report product defects and to request one of the remedies listed above, Customers may contact sperare at the addresses in paragraph 12 below.
8. Returns - Withdrawal
8.1. The Customer has the right to withdraw from the contract within 14 (fourteen) days from the delivery or receipt of the Products, with the exception of Personalized Products. For the separation of Orders, the relevant time limit must start from the day of delivery or receipt of the last Product.

8.3. In the event that the Customer complies with the procedure provided for in the above paragraph, the Products to be returned are sent to the Customer. In the event that, however, the Customer does not comply with this procedure, the Customer will be responsible for the return costs, while being responsible for any loss, theft, damage or delay.

8.5. The Customer undertakes to return the Products for which he has exercised the relevant right of withdrawal, without undue delay and in any case, within 14 (fourteen) days from the date on which the exercise of the right of withdrawal is notified to sperare.
8.6. Products must be returned in the same condition in which they were delivered. That is, the Customer must ensure that the Products are intact and complete, that they have not been used, worn or damaged in any way and that they have been returned in their original packaging, together with all the tags with which they were received. In the event that a Product has a security label, the return of that Product will not be accepted if the original security label has been removed, broken or damaged. The Customer is also informed that, for safety and hygiene reasons, perfumes cannot be returned if the cellophane seal and original packaging have been opened, damaged, altered or removed.
sperare will check the packaging and the conditions in which each Product is returned, with substantial integrity being a necessary condition for exercising the right of withdrawal. sperare reserves the right to refuse the return of Products that have suffered damage or deterioration, have suffered stains or appear to be in a condition that shows beyond doubt that they have been used for purposes other than those considered strictly necessary to ascertain its nature and characteristics of Product purchased by the Customer. In the event that the return is rejected, sperare will send a specific notice to the Customer, also reserving the right to claim compensation for any damage attributable to the Customer's conduct.
8.7. sperare shall refund any sums due for the returned Products without undue delay and in any case within 14 (fourteen) days from the date on which sperare was notified of the Customer's exercise of the right of withdrawal. In which case, sperare reserves the right to withhold the return either until the Product has been received and verified or until it is proven that the Product has been properly returned and in an undamaged condition, whichever occurs first. The above-mentioned refund must be made by crediting the amount paid by the Customer, unless there is a different agreement with the Customer and provided that no costs incurred as a result of said refund are incurred.
8.8. sperare has no obligation to refund the shipping costs of the Products in the event that the Customer has chosen a specific shipping method, different from the standard one offered by sperare.
8.9. The return of Products in accordance with this chapter is permitted only in relation to purchases made on the Website.
8.10. Since Personalized Products are products that have been permanently modified, and personalized specifically for the Customer, and their original construction cannot be restored in any way, the right of withdrawal cannot be exercised by the Customer for Personalized Products. Consequently, the terms contained in this paragraph 8 do not apply to Personalized Products, as it is understood that the exclusion of Personalized Products from the right of withdrawal does not affect the application of the legal guarantees, as provided in paragraph 7 above, even to said Products .
9. Limitation of Liability
9.1. Except in the case of fraud or gross negligence, sperare is not liable under any circumstances to the Customer for any indirect or consequential damage that may arise from the purchase of the Products available for sale on the Website.
10. Product Authenticity and Copyright
10.1. sperare guarantees the authenticity and high quality of All Products available for sale on the Website.
10.2. The sperare brand, as well as all visual and non-visual marks and, in general, all marks, illustrations, images, logos are and remain the exclusive property of sperare. Reproduction, in whole or in part, modification, falsification of such marks, illustrations, images or logos for any reason and in any manner is strictly prohibited.
11. Litigation
11.1. These General Terms and Conditions of Sale are governed by Greek law and should be interpreted accordingly
11.2. Στην περίπτωση κατά την οποία μία διαφορά ανακύπτει από την ερμηνεία ή/και την εφαρμογή των Γενικών Όρων πώλησης του παρόντος, το Δικαστήριο του τόπου όπου έχει την κατοικία του ή τη διαμονή του ο Πελάτης, εάν βρίσκεται στην Ελλάδα έχει αποκλειστική και υποχρεωτική δικαιοδοσία. Στην περίπτωση κατά την οποία η έδρα ή η κατοικία του Πελάτη βρίσκεται στην Ελλάδα, ο Πελάτης δικαιούται να επιλέξει να εισάγει τη διαφορά είτε στο Δικαστήριο όπου έχει την έδρα ή την κατοικία του είτε σε δικαστήριο της Αθήνας. Εναλλακτικά, ο πελάτης, μπορεί να επιλέξει μία διαδικασία εξωδικαστικής επίλυσης της διαφοράς που προβλέπεται σύμφωνα με τους ισχύοντες νόμους, όπως η πλατφόρμα που παρέχει η Ευρωπαϊκή Επιτροπή, διαθέσιμη στην ιστοσελίδα http://ec.europa.eu/odr.
